What Are Affidavits?

Affidavits are legal statements that are written with the intention to make an oath when stating facts about a person or situation especially in litigations. Affidavits can be written by anyone as long as you have the knowledge about the format and purpose, but they can only hold water when it has the authorized notarial seal and signature of a notary public. There are many types of affidavits such as an affidavit of loss, affidavit of no work experience, joint affidavit, affidavit of support, and many others which you can make with or without the help of a lawyer.

How to Write an Affidavit Letter?

If you want to make an affidavit letter, you only need to have the right material so you can start making one. You could also follow the steps which we have provided for you below so you can kickstart your task right away.

1. Write Affiant Details

When writing affiant details, you need to be specific and correct, as the identity of the affiant is very important, especially if there is a background check involved because of litigations. Information should include their full name (put aliases if necessary), complete address, age, marital or social status, as well as contact information which you would then write down on the acknowledgment part later on. If there are more than two affiants, you can write down their names separated by commas.

2. Write the Body of Your Affidavit Clearly

The body of your affidavit cites the relevant information about the affiant’s purpose of making a statement in the first place. If they are making a sworn statement to support their child going abroad, then provide information about where the child is going, and how they are willing to shoulder the expenses of the child. If they want to testify about a fraudulent transaction, then they can incorporate details of what really happened during the transaction and what they did before or after that. A complete description of details would really help the judge make a clear and concise decision on the case thereafter.

3. Have the Document Acknowledged Legally

After writing your affidavit letter, your next move is to have the document sealed and notarized. You only need to find a notary public whose license to notarize is not expired and who is still able to make witness to your oath. If you cannot find one in your area, then go to your nearest city hall or the judicial hall since they have someone who is also authorized to acknowledge documents like yours.

4. Always Keep a Copy

Always keep a copy of your affidavits so that when the time comes if you need them for something, you can still present them to whoever requires them. Put it inside a safe plastic folder or have it copied digitally so you can save it on your computer or HD device.

Why are affidavits important?

Affidavits are important because it provides descriptive information about a person or incident from a firsthand view of the affiant, which is really helpful in verifying certain truths in situations.

What is an affidavit of non-operation?

The affidavit of non-operation is a legal statement that states the reason why a company or small business is not operating any longer. It also shows the date when the company decided to close its doors.

What is a joint affidavit?

A joint affidavit is a document wherein the affiants of the document are two people vouching for a certain person when it comes to the truth of their birth or death and that the subject of the affidavit is one and the same person.

Affidavit letters are one of the best documents in the legal world as they boost the credibility and accountability of the affiants, making it easier for judges or agencies to verify the truth of any matter.
