The Different Types of Employee Leave

Bereavement

This type of leave occurs when a close family member of an employee passes away, these family members are often categorized as those immediate ones. Maternity or Paternity Leave

There is no federal law which requires maternity or paternity leave, but several states, such as New York, New New Jersey, and Rhode Island passed laws requiring paid family leave, encompassing both maternity and paternity leave for either having or adopting a child.

Medical Leave

Due to sickness, illnesses, check-ups and injuries, an employee has to take a leave in order to fully recover from the dilemma. This type of leave is often granted by the regular employees or those who render enough years to be considered one. This should secure a medical clearance or medical certificate upon return.

Jury Duty

It’s against the law for a company to penalize an employee for jury duty at the federal level of some states. And while it’s not required at the federal level to pay an employee for time spent at jury duty, there are often a variety of state and local laws that require payment. Therefore, it’s important to look up the laws that dictate jury duty based on where your company is located.

Caretaker Duty

If someone close to your employee is in failing health or needs assistance, they can consider “caretaker duty.” Other companies, establishments and institutions are very strict in establishing rules and implementations with regards to this leave.

Can you fire someone because of excessive absence?

Yes, in general, if an employee has an excessive amount of absences you may be able to terminate his/her employment. If it’s for medical reasons and the employee is FMLA-eligible and s/he has not exhausted his/her leave time though, termination would probably violate the FMLA.

Can I get fired for calling in sick often?
