  1. To prevent abuses – Between you and your users, a Terms of Service agreement serves as a legally binding contract. The Termination clause is intended for websites with a registration section (for example, a user must register before using and/or accessing certain sections of the website), as it allows you to disable or ban abusive users based on their account activity.
  4. To limit liability – A warranty disclaimer is commonly included in Terms of Service agreements to limit the website owner’s liability in the event that errors are discovered in the content presented on the website. This type of clause informs users that the owner cannot be held liable for any errors in the content presented, or for the accuracy, completeness, or suitability of the information provided for any purpose.
  5. To set the governing law – The Governing Law clause of this agreement usually refers to the jurisdiction that governs the terms of the contract. Update the agreement to include your home country or the country in which your company (that owns and operates the website) is registered if you operate your website from another country (Australia, UK, Canada, South Africa).
