Under the United States Federal Law Act of 1974, any collection, use, and dissemination of personally identifiable information on individuals, especially the disclosure of personal information, is prohibited without the written consent of the subject individual. This is to ensure the right to privacy among individuals and prevent abuse from different government agencies when dealing with personal information.

The privacy act release is doubly important for military veterans or immigrants who deal with agencies that need further information regarding their requests for service from any of the agencies. For example, when dealing with social security issues, the government agency concerned may ask for additional information before any considerations may be given. Concerns regarding pensions and in the case of immigrants, their statuses to ascertain the legality of their stay, need inter-agency information before any of their government transactions can be acted upon.

In recent times however, the danger of domestic and international terrorism have become a real concern in governments around the world. The United States government is equally concerned about the influx of immigrants over the years where minority communities give rise to domestic and homegrown terrorism issues. For this matter, the routine use of individual information within a U.S. government agency is allowed to try and prevent domestic terrorists from wreaking havoc and disrupting lives within its citizenry. While privacy is of the utmost concern for all individuals, advances in technology have made it harder for individuals to keep most of their personal information private, giving real concerns that the government may be spying on its own citizens.

As shown in our samples, the privacy act of 1974 also prohibits educational institutions from releasing students’ information under the Family Educational Rights and Privacy Act of 1974 (FERPA). Under this provision, information regarding a student’s status, grades, educational progress to obtain a degree, and overall campus experience cannot be released even to parents and guardians of the student. Unless the student gives a written permission for his academic records to be accessed, even family members cannot readily be given access to school records. The student therefore has the right to give access or refrain from granting one without his written consent.
