Types of Claims
We might have heard about a lot of types of claims. Here we will be discussing the three types of claims.
Claims of Fact
A fact is defined as something that has actual existence, or something that is proven to be true. A factual claim then refers to facts and details that are supported by truths. They make conclusions based on the past, present, or future conditions. It is also called an evaluative claim. Since this type of claim is based on facts, it should contain specific details about the time, the place, the situation, and the people who are involved. Arguments are provable in factual claims. An inference should not be confused with facts. An inference is an opinion or statements that are formed because of known facts.
Here are the types of factual claims:
- Factual or historical
- Relational causal relations
- Predictive
To prove a factual claim, the following is required:
- terms that have a clear definition
- an authority that is reliable
- recent and accurate data
- shows a clear distinction between inference and fact
Claims of Value
Values are a person’s set of standards or principles of behavior. A claim of value is used to express approval or disapproval or it also strives to prove that some event, thing, action, or condition is right or wrong. They also make value judgments, evaluations, appraisal, or resolve a conflict between values. A lot of times claim of value involves an individual’s taste in art, music, literature, film, opera, etc.
To prove a value claim the following is required:
- the advantage of one’s standards should be established
- value is prioritized in this case
- use of credible authorities
- abstract values should be clarified with examples
- a standard of evaluation should be established
Claims of Policy
This type of claim involves sub-claims about both fact and values. It provides a solution or provides additional series of questions as a reply to the claims of fact. A specific course of action is needed to decide if a policy should take place. A claim of policy is also often an organized plan.
To prove a policy claim, the following is required:
- there is a need for justification
- proposed actions should always be clear
- certain opposition or counter arguments should be considered
- there should be advantages
- there should be a workable plan
Legal Claims
What is a legal claim? A legal claim is an assertion, a demand, or a course of action that is taken by an individual who wants to get compensation, reimbursement, or payment for a loss while still under a contract. Another reason for a legal claim is for an injury that is caused by negligence. Some cases of negligence involve medical negligence because of the fact that the injury wouldn’t happen if a certain somebody was not negligent.
