A construction contract agreement is very helpful. It totally details and defines the cope of work to be done and the specifications on the structure that needs to be followed. Oftentimes miscommunication and change of plans happen with frequency in construction projects given the fact that it involves frequent planning and supervision of a sizable force of manpower. If a building several meters high is to be constructed, each section has different supervisors managing the workforce, so oftentimes it gets pretty hard to collaborate on the exact details of the building’s blueprint. To prevent this and to ensure the contractor is following on the exact specifications detailed on the blueprint, the contract agreement being signed will remind the contractor of his binding obligation to follow everything according to plan.

For the contractor, the contract agreement is also important and an advantage on his part because it ensures that the owner is legally bound to pay him for his services. It also gives him a clear view of the scope of his responsibilities, the schedule with which he has to follow in order to meet the timeline, and finally as a document of proof, which he needs in order to collect payment.

As shown in several of our samples, in order to be effective and binding, the contract must be put into writing, which must contain a clear and concise description of the kind of service offered and being delivered. The wordings would be placed in such a way that it is clearly understood by both parties who each have a responsibility on the contract. The financial terms must also be clearly stated to prevent misunderstanding, and finally, for the benefit of both parties in case of misunderstanding or disagreement, a clause for cancellation or termination of the policy must be included.

In general, a construction contract must include the stipulations and terms of the contract in what is commonly referred to as an express contract. For both owners who may want to provide stipulation for a time period, which the contractor must adhere to in order to finish on time, an executed contract is preferred that includes provisions for when there are obvious defective or incorrect installations or wrong specifications. The contractor would be either bound to correct such mistakes or be held legally liable for such defects. Finally, a conditional contract may also be applied if for some reason, a contractor fails to provide service due to either uncontrollable events or misunderstanding of contract guidelines. It will stipulate a future date when services will be rendered after some conditions will be met.
