What Is the Difference Between a Rental Agreement and a Lease Agreement?

We see ads showing the words lease and rent, and they sometimes are written side by side, like for lease/rent. The first time I saw that it made me wonder what their difference is. I asked a lot of people and made my own research. It took a lot of time though as I was actually really looking for a distinct difference between the two of them. Luckily, you won;t have to wait as long as I did because I’m going to share with you the differences between a rental agreement and lease agreement that you know of.

Rental Agreement

  • Length – A rental agreement is known as a short term tenancy that usually lasts for 30 days. Most rental agreements are on a monthly basis and the payment arrangement is also done this way. A tenant can stay in the rental property for as long as they are able to pay for their monthly dues and follow terms and conditions stated in their rental contract.
  • Making changes – Since a rental agreement is on a monthly basis, the landlord can make changes to the agreement every month and the tenant can also request for some changes for the next month. These changes include increasing the rental price and terminating the contract by the end of the month or the next month, which is of course done properly using a written notice.
  • Renewal – Rental agreements automatically renew unless either the tenant or landlord wishes to end it by properly giving a written termination notice.
  • Advantages – The good thing about a rental agreement is that both landlord and tenant are not bound to it for a very long time so they can decide to make changes whenever it is convenient.
  • Disadvantages – Landlords can decide to terminate the rental agreement by the next month or increase the rent by the end of the current month. if the tenant disagrees, then they will need to move out. Lease Agreement

  • Length – Lease agreements last for 3 months up to a year or longer. They are long term agreements that allow a tenant to occupy the said property for a long time, regardless if they would be staying their or not.
  • Making changes – Once the agreement has been agreed upon by both landlord and tenant, no changes can be done to it until it expires or until the agreed number of months or years has lapsed.
  • Renewal – Unlike a rental agreement, a lease agreement does not automatically renew after the said due date. In order to renew it, the tenant may write a request for renewal or the landlord may issue a renewal notice giving the tenant an option to renew or not together with the new set of terms and conditions.
  • Advantages – Leased properties provide owners or landlords a continuous stream of profit or cash flow as they will still get paid regardless if the tenant uses the property or not. Tenants need to make the required payments until the agreement expires.
  • Disadvantages – A lease agreement does not allow for any changes before the agreement expires. This means no pricing changes can be done even if the cost of living and other things have increased.
