Definition

By definition, an agreement is basically an arrangement or understanding between the parties involved. A contract, on the other hand, is a type of agreement that is considered to be legally binding and lawfully enforceable. In short, all contracts are considered as an agreement but agreements are not contracts in itself.

Requirements

When it comes to requirements, agreements do not need a lot. A simple mutual understanding between the parties is enough (see Mutual Confidentiality Agreements) as long as an assurance for doing the tasked responsibilities are implied. For a contract, the requirements are quite tedious, precise, and stricter.

Benefits/Advantages

Both contracts and agreements come with their own set of benefits/advantages. One advantage of an agreement is the fact that it is informal. Parties who have known each other for the longest time and have already established trust for each other make use of agreements. The reason for this is the fact that agreements will help to save time and allow the fulfillment of the obligations of each party in a more flexible manner. It is applicable for circumstances wherein drafting a contract will take too long.

What Is a Transfer Agreement and Why Should It Be Written?

A transfer agreement, as its name suggests, is an agreement to have a patient, an employee, or student to be transferred to another hospital, a new office location, or new college, respectively. This agreement will usually cover

A service level agreement or SLA is an agreement between a service provider and an end user that defines the scope and limitations of the services that will be provided by the service provider. In short, it gives a definition about what the customer will receive.

In writing an SLA, one should remember some key elements to include.

  • The scope of the services to be provided. This will also establish the functions, processes, and activities that could be performed by the service provider.
  • The reasons why the service is provided, who is going to perform the service, who makes the decisions, and who is liable for the results of the service.
  • The day-to-day activities that are correlated to the services of the service provider.
  • The fees and finances of the service provider. This includes the costs, variances, settlements, payment arrangements, and modes of payment that are available.
  • The expected outcome or end result of the provided service.
  • The implementation process, which will include the customer support, a timeline of the activities performed such as consultations (see Consulting Agreement), effort that is required for a specific activity, the responsibilities of the customer and the service provider, and risks at hand.
