A contract agreement usually includes specific terms in a business between two parties. A service contract is made to deliver work or services in return for compensation that is governed by the specifics of the terms of agreement. Once the contract agreement is signed by both parties, it becomes legally binding and enforceable. Any breach of contract may be subjected to litigation.
Both contract of service and contract of employment basically mean the same thing. A contract of service, meanwhile, is often distinguishable from a contract to supply services that may mean anything from supplying personnel for maintenance services to medical personnel and security, which is basically anything that is not confined to a department or function and independent from the company.
A contract agreement may involve anything from building structures to farming services, employment, and general services such as staffing contracts. A contract agreement will bind the contractor on a project until such time the contract is finished or terminated by either one of the parties. Contractors may be hired or work independently, but both client and contractor are bound by the terms of the contract until such time work is completed in the span of time being specified.

No matter how limited the terms of agreement are, it’s always good to have a contract for the protection of both parties, not just doing work at the behest of a handshake. Having an unwritten contract can be dangerous if one of the parties fail to deliver and the responsibilities are not being performed, plus there’s an added danger of either not getting a fair price for the service on the side of the client, and the danger of not getting paid on the side of the contractor.
The existence of a contract requires the elements of an offer, acceptance, promise, valuable consideration, time, terms and condition, performance, and finally, payment. Without these elements, a contract agreement may not work properly and the credibility of the agreement will suffer as a consequence.
When things don’t work out and either one of the parties wishes to terminate the contract, it should be done so in writing and both parties should come to terms and iron out differences before signing the termination of contract. If no agreement is reached, then it may be time for one of the parties to consider legal action through the small claims court.
