What Are the Essential Elements of a Contract?
A contract is a legal document but not all contracts are enforceable in a court of law. This is because not everybody knows how to make a legally binding one. There are certain elements that need to be present in a contract for it to hold itself legally. Here are the elements that need to be present in a Legal Contract.
- Offer – The document needs to contain an offer to do something (e.g., lease offer, offer to deliver goods, etc.).
- Acceptance – There needs to be an official acceptance of the offer as well as all the terms stated in the contract. Only the things offered in the contract can be accepted.
- Intention of Legal Consequence – The parties involved need to acknowledge that they are entering a legal agreement and that they are obligated legally to adhere to all the terms stated in the contract.
- Consideration – This means that one party must be able to offer something in return.
